San Jose Measure B Stayed Until June 2015

Judge Lucas has entered a judgment in the Measure B litigation, which has the effect of making her prior decision final, binding and enforceable. The judgment reflects her final decision to strike down the major pension-related provisions of Measure B applicable to current employees, while upholding other provisions related to retiree health and the supplemental retiree benefit. The parties to the lawsuit -- the City and the various unions including AFSCME Local 101 -- will be considering their options to appeal the ruling. An appeal has already been filed by one group of plaintiffs. The City has agreed to a stipulation to stay the implementation of Measure B for another year, through June 2015, while the appeals process plays out.
